"The important thing for Jerry Maness is to prove his ownership," Wood says. "Then there may be a reason to show liability on the part of the sheriff." The county probably will request that Fowler be present during its case, and it may be difficult getting the ex-sheriff here, says County Attorney Howard Douglass.

In any case, testimony can be obtained from those unable to attend the trial, he says. Fowler is serving state and federal prison terms for raping and assaulting prisoners in his jail. Fowler pleaded guilty to violating the rights of jail inmates in 1988 in exchange for a 10-year sentence. In May of 1989, the ex-sheriff pleaded guilty in state court to charges of raping prisoners in exchange for a 20-year prison sentence. "It's an interesting case, an unusual one.

But it will all depend on Maness and his proof," Wood says. Maness says he just wants to get to court His lawyer echoes those sentiments: "I want him to have his day in court, too." "If I can get to court," Maness says, "I've got the case won." Out-of-state: Jackie R. Mason, Clinton, Ky. Weakley: Grace L. Boone, Dresden.

MARTIN HCA Volunteer General Hospital Admitted Thursday: Diane Shanklln, The Henderson County Circuit Court has had the case on its docket for about the last year, but it has been continued, says Rebecca Clement, deputy clerk. It's unknown when Maness lawsuit against Fowler will heard. Records show it is not unusual for civil cases to take a long time before they get in court "I have four or five cases that go back to 1984.

Our criminal cases always take precedent over civil cases," Clement says. "It's just an over-worked system." But Maness notes a discrepancy between the items listed on the search warrant for his house and the items taken in the raid. The warrant stated that Maness was believed to have "stereos and a television stolen from Wal-Mart, Sears and mart stores." Maness says some of the things taken from his home included a wooden box of silverware, king-size down pil- Brighter Christmas Fund, in care of Union Planters National Bank, P.O. Lexington man presses lawsuit against ex-sheriff CANDLESTICK h'M With Shad. ft MM SELECTED MERCHANDISE From 3A cash equivalent Maness, who is asking for a jury trial, says he got some of his property back, but much of it was damaged. At issue in the case, Wood says, is the question of who owns the articles. About a year after Maness filed his civil suit, mart filed a lawsuit in Chancery Court against Maness, his wife, Patty Maness, and his sister, Velma Maness. The case of Maness versus Fowler and Henderson County and the case of mart versus the Manesses were combined.

Recently, Circuit Court Judge Franklin Murchison separated the cases. That move should expedite matters, Wood says. But Maness says he wanted the cases to remain one. The case involving mart against the Manesses should come up on the court docket near the beginning of 1992, Wood says. 29.95 PILLOWS LL Wall DESIGNER Clocks fegulir 10 Quirti Aoeunuy 9M.
